How long do I have to file a case in probate court?

Ok, I might as well tell the whole story... Someone hit my car and ran in August, 2010. the police found him and he wasn't insured. My insurance told me I had to file a small claims. So I kind of procrastinated and waited till May, 2011 to file it. In that time the defendant died, In November, 2010, so my real question is; can I file a suit against his estate or whatever, or is it too late. Since he did die 6 months ago.
